This document constitutes an understanding and a contract between us and you should read it carefully and raise any questions and/or concerns that you may have before you sign it. 

 

Description of Services 

 

The services to be provided by Indigo Airwaves are coaching and/or tele-coaching, and teaching as designed jointly with you, the Client. An initial assessment will be used to exchange valuable information to guide and focus our coaching relationship. 

 

Fees 

 

The initial assessment is free and, once a plan is agreed upon, coaching sessions and communications will be charged at the rate listed on our website. Fees for coaching sessions and communications must be paid promptly at the time of booking, unless otherwise agreed upon.

 

Cancellations 

 

You must give 24 hours notice if you need to cancel or change the time of an appointment. Otherwise, you will be charged for the session in full. Indigo Airwaves agrees to make every effort to reschedule sessions which are canceled in a timely manner. 

 

Refunds 

 

The Client may request a refund if they cancel their appointment with at least 24 hours notice.

At Indigo Airwaves, we care deeply about the well-being of our Clients and we provide guidance to the best of our ability based on our own knowledge, as well as the information you provide to us. We are dedicated to working with you in the pursuit of your increased well-being, happiness, prosperity, and spiritual development. All advice given in sessions will be for the purpose of helping you, the Client, to progress. We commit to you that we will always act in good faith and with your best interest at heart.

 

Disclaimers

 

Coaching is different from psychotherapy — it neither is, nor purports to be, a substitute for psychotherapy. We are committed as coaches to helping you achieve your goals and progress in your personal development. We also recommend that if you are in need of psychological counseling, you seek out additional help from a licensed professional.

Medical Disclaimer

 

As coaches and educators, we also offer health and nutrition coaching, which is not medical advice. This should not be a substitute for consultation with your own healthcare provider. Our coaching is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

Agreement

 

Some means of communication, such as wireless telephones and email may be not secure from eavesdropping. It is impossible to guarantee the protection of confidential information in certain circumstances involving computers. You acknowledge that Indigo Airwaves cannot be held responsible for instances of loss of confidentiality through wireless telephone or computer hacking.

Dispute Resolution 

 

Any controversy or claim arising out of, or relating to this Agreement, or the breach of this Agreement, shall be settled by binding arbitration, which will occur via telephone by an arbitrator that we mutually agree upon. The costs of the arbitration shall be shared equally between the parties.

Confidentiality 

 

This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this relationship, is considered confidential. However, please be aware that the Coach-Client relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege. The Coach agrees not to disclose any information pertaining to the Client without the Client’s consent. The Coach will not disclose the Client’s name as a reference without the Client’s consent. Confidential Information does not include information that: (a) was in the Coach’s possession prior to its being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the Client; (d) is independently developed by the Coach without use of or reference to the Client’s confidential information; or (e) the Coach is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; and (g) involves illegal activity. The Client also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner. 

 

Limited Liability 

 

Except as expressly provided in this Agreement, Indigo Airwaves makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall the Coach be liable to the Client for any indirect, consequential or special damages.
